I won my Alibaba Dispute

Investor summaryNeutral

Author won an Alibaba.com dispute against a deceptive seller via chargeback threat after the mediator initially sided with the seller.

Bear points
  • Platform mediators may initially side with deceptive sellers, causing frustration.
  • Sellers can use sneaky tactics like adding unrequested items or raising prices.
Post body

I had a dispute with an Alibaba seller that ended up in my favor, even though they initially sided with the seller.

Let me preface this by saying I won’t mention the name of the product in this post for traceback reasons, but I will give enough details.

I ordered some products and met the seller’s MOQ limit, but the seller tried to be sneaky and I didn’t catch it until the next day. They had basically put items that I did not ask for in the quote. Granted, I was willing to work with the seller to get a modification because I thought it was “fixable” and just a mistake, so I didn’t have my guard up. Keep in mind they had already increased the shipping price and the item price, and when I confronted them they made excuses.

So what led to the dispute? After I requested a modification, they started telling me the initial product I wanted was a “specialty” item that required additional days to make. In hindsight, they were probably going to use this opportunity to charge me more. So I opened a dispute. The seller then became very “understanding” and wanted to work things out, but in order to make things “right” I had to withdraw my dispute or change the reason for my refund to “change of mind.” I firmly declined. She was being nice to me via chat and offering me a refund, but on the other end she was trying to build a case against me, essentially arguing that she wouldn’t be refunding me.

Long story short, the Alibaba mediator finally joined the chat and told me he couldn’t tell the seller to give me a refund because the items were “custom.” Reading their response enraged me, so I escalated it. I told the seller and the mediator in plain terms: “Either Alibaba gives me the refund, or I’ll have the bank issue the refund.” With less than two days left for the case to close, the seller reached out and asked again if I could withdraw my dispute. Once again I told them to let Alibaba process my refund and to let the mediator know they wanted to refund me. With less than 24 hours left, the seller shockingly added to the chat that they wanted to refund me and that Alibaba should process it.

So what did I learn from this experience?

1. Trust your gut. If a seller is acting weird, start the refund process before the item even ships. Why? They can’t ship it until an agreement is reached, especially if the item is incorrect.

2. Stand firm in your decision. The seller tried to appeal to my emotions by saying she’d get fired if I didn’t change my refund reason or withdraw it. I’m glad this didn’t move me one bit, though it did make me highly suspicious of her.

3. Use a credit card. This will be your saving grace, because if Alibaba decides to screw you over you have an additional layer of protection.

4. Trade Assurance is not there for you. It’s there for Alibaba to make money by leveraging your trust, and to help bail out their sellers.

5. Sellers only care about their standing, not the service or product they provide. This incident made it very clear to me that customer satisfaction is a myth for many companies, as long as they can make money.

6. Be ruthless. Don’t allow yourself to be bullied or outnumbered.

7. Know your rights and file that dispute early. The earlier you start the dispute, the better off you are.

Good on you for not backing down! Sellers begging you to use 'change of mind' are just trying to dodge platform penalties. Never fall for it. Mediators always struggle with 'custom' orders, but keeping the dispute open and the evidence in the chat is exactly how you force Trade Assurance to do its job. Did you end up finding a better Verified Supplier to remake this, or did this headache make you scrap the project?

Glad you pushed through with the dispute instead of giving up halfway. A lot of buyers panic when suppliers stop replying. Nice to see Alibaba actually followed through after reviewing the evidence properly.

Absolutely! They only followed through because I threatened to do a chargeback and that would reflect on the seller for PayPal.
