Need advice: Freight forwarder in Alibaba dispute threatening to destroy or sell my cargo
Hello everyone,
I need some advice regarding a dispute with a freight forwarder.
I booked an all-inclusive shipment through a Chinese freight forwarder. After they took possession of the goods, they demanded an additional $224 that was never part of the original agreement. The biggest issue, however, is that instead of normal destination charges of around €300–€600, they are now demanding €4,275.
I have evidence that comparable DDP offers were significantly cheaper, even though those offers included delivery to the final destination over 1,000 km away plus import duties and taxes.
The cargo arrived at the port on December 18. According to the local agent in Slovenia, I could not collect it immediately because it first had to be unloaded and transferred to a warehouse. The goods have only been available for collection for about five days.
I opened a dispute through Alibaba. While the dispute is still ongoing, the freight forwarder is now threatening to destroy the cargo or sell it to someone else if I do not pay the disputed charges. They even contacted the Slovenian agent and claimed that a buyer from the Czech Republic is interested in taking over the goods.
My questions are:
Can a freight forwarder legally destroy or sell cargo while ownership is disputed and an Alibaba dispute is still ongoing?
Can they transfer the goods to a third party without my consent?
Has anyone experienced something similar with Alibaba Trade Assurance or freight forwarders?
What would you recommend I do at this stage?
Any advice would be greatly appreciated. Thank you.
Since the terms are DDP, you should not have to bear this additional shipping cost.
Oh my god,it's a sad story.
No they can't contact your lawyers and go to the warehouse yourself the extra money you paid is already lost you can't retrieve them as they are in China but AlIbaba may help you
Screenshot every info and every message. And show everything to Alibaba,do not think Alibaba will help you 100 percent you need to take action on your own hands if you need help send it
Ich habe noch nichts bezahlt . außer die 224 Dollar mehr in China . Mehr Sorgen macht mir die 4.275 Euro die sie im
Zielhafen möchte und droht es an andere zu übergeben.
Because you will be required to pay that 4k euros to release the shipment, what you can do is because the shipment is in EU you have excellent consumer protection.
Contact your lawyers and because the shipment is already in EU it's safe and also prepare screenshots, that they threaten to hand it over as it's illegal and you can
a) Win the dispute in AlIbaba
b) In the port they will see it's illegal what they are doing because you already paid and agreed the terms
I wish you best of luck
Dankeschön sehr freundlich
