Google's AI falsely linked two publishers to scams and fraud. The publishers sued. Google argued users should fact-check AI outputs themselves. The court threw that defense out completely saying if users have to fact-check everything, the feature is pointless anyway.
The court stripped Google of the liability shield that has protected search engines for decades. AI Overviews generate "independent, new, and substantive statements" that makes them Google's words, not a list of links to other people's words. This isn't just a Google problem. If courts increasingly determine that AI-generated outputs constitute the speech of the companies deploying them, the implications could affect virtually every major AI provider .
In case you didn't know most AI answer correctly 91% of the time, meaning they are wrong 9% of the time. It's a lot of mistakes. Right now, suing an AI company is hard because you have to prove they were careless. In 6 months in Europe, you just have to prove the AI was wrong and it hurt you.
I'm not saying AI will go down, but this might be the a big reality check for AI accountability.
